There are only two times where this can be twisted, and that's in the Filler where Gohan goes SS for the first time and Kakarrot's Genkai Dama against Chibi Boo. 1. Gohan clearly breaks his beam and bursts out in anger, then deflects his fathers beam. 2. Kakarrot had quit fighting back and had already accepted defeat, allowing Chibi Boo to do whatever he wanted with it. This even breaks TOEI's logic. I know this is starting an argument, but in no where has it ever been possible for a Transformation to occur during a beam struggle. And No. The Kaioken is NOT a Transformation, it's merely a boast and only that.

On topic, this is something that's always debated amongst fans. Some believe Goku was an SSJ and others believe he was an SSJ2. His hair was SSJ2 like at the end of the struggle and is shown as an SSJ2 in various concept art though the flip side to that is that he was shown as a regular SSJ in other concept art. Not to mention Goten was shown as an SSJ2 in one concept art as well lol.

I get the argument, but it's hard to go with that even when it's already been shown that they've never been able to before. Because doing so can put Broli at a higher level, or I guess you could argue that since Gohan was strong enough to damage Broli could suggest that it wouldn't take a lot more power to destroy him.
