Dead Teen Sued for Losing Control of Flying Body Parts

The woman apparently broke her leg and wrist. That's a pretty heft hospital bill if you think about it. If she's uninsured, like most Americans, then she's probably suing because she just doesn't have the money to pay for her medical bills.

Also, are you sure this is legal? I took a criminology class last year and he told us that you needed intention to sue. he gave us the example that if a man with a bad axe was chopping wood, and the blade flung off cause it was old and it hit someone, then he couldn't be sued if he hadn't known it was old and would slip off. however, if he had known the blade could slip off, then he could be sued.
i realize he was running across train tracks and, yes, being hit is foreseeable if you're gonna run across the tracks, but arn't trains really easy to spot? was he just being really stupid?
You can sue the person's estate, not the person, lol.
what does that mean?

I edited my post before you replied. I read your question wrong. Thought you said, "is it possible to sue someone who's dead?" I edited it though, because I read it wrong.

There's really no way to make a perfect law-system. So I don't blame the american judicial system for allowing something like this to happen. I do, however, think that people have responsibility in using their law-system in ways that don't take advantage of others. Something like this is a very horrible thing to even consider doing.

Well, anyway, yeah, this is a case in which laws conflict with morals. Technically, she does have the right to sue, but she is a really depraved person for doing it. If we had a perfect law system that agreed with morals, this case would not get through.

Yeah she has the right to sue legally. However I see it as a bit ridiculous. Considering the teen is dead and his family have grieved for him, this is just a massive slap in the face to the family. It just seems immoral to sue someone who died.

The whole point of a legal system is that it reinforces morals, that's a load of balogna Cal. If the legal system didn't reinforce morals, there would be no punishment for murder. Whether you're religious or not "Thou shalt not kill" or whatever, is a fairly fundamental rule in western society at the very least and there are punishments for it. The same is true for stealing and all other crimes which the legal system is meant to protect the rest of society from. It wouldn't be law if there were no morals involved, that's a ridiculous notion.

I'm more inclined to say that the healthcare costs are too high and so she's sueing because of the cost. That's the only way I'd feel any sympathy for this woman, and even then not very much. Try suing the rail company or something, just don't disrespect the deceased by sueing them over their own death.

Is this a joke? What in the world is going on when we are saying getting hit by a train is carelessness. It wasn't a suicide people she has no right to sue a dead person that shouldn't be allowed in any case. This lady should be fined for having wasted the courts time with such a silly in a disgusting attempt at getting money..
