Kids stabs bully 12 times, gets away with murder charge

There is so much more to this that we down know about, honestly, the only time I would pull a knife out on someone is if they were harming my family, and I would stab them once or twice, not 12 times! It seems to me that the kid with the knife wanted to kill him, he could have easliy learnt Kakarate or MMA or something to teach the bully a lesson, but he had to bring a Knife, this kid sould go away for a long time, he took somebody's life for pete sake!

I wouldn't kill him but I can't lie I'd do the same thing. Bullies are just *****ing annoying. Still killing is killing and he has to go through he's due process.

Well ok he did stab him but the worse thing is that he stabs him 12 times! In my opinion he probably snap. We don't know how bad the bullying was. Now I am not sure what to exactly think of this.

I'm going to see if I can look up the judgement on this when I get back to uni, I want to see the judges full reasoning. As far as I knew, stand your ground laws only applied to home invasions. This seems more like it falls under self defence.

I wish American and Australian laws will change, so this crap can't happen, if I had anything to do with it, that kid will be gone away for life.

I have a little, I was mugged once and tried to defend myself there. Didn't do very well, the guy took what I had (which wasn't a lot) and I got a few hits to the face for it. I admit, it's scary. I probably would have stabbed the guy if I had the chance (or a knife, for that matter). It's not the same as repeatedly stabbing someone though.

My brother got mugged but there was no violence involved. Oh and somebody invaded his house and got him by the the throat and threatened him. :) He's not the most fortunate person in the world.

I think Fulgore is referring to Fight or Flight? Where the primal part of the brain takes over your judgement and your body reacts without you "telling it to" which if you've been in this kind of situation you know exactly what I'm talking about.

I know what you mean. Over here there's a defence to murder that goes like that, but the burden of proof is very high and difficult to meet. It's difficult to prove whether you have control or not and the burden of proof is on the one using the defence.

What if the kids poor and can't afford taking a martial art? The kid was 14 and been bullied for years probably. Like most kids he probably kept it bottled up inside and when it started getting bad he bought the knife. And the bully was 16 and had some buddies with him. The kid tried gettin off early and they followed and attacked him with the intention of hurting him. While 12 times may have been much your acting as if he were an adult. This is some kid, is probably going to be haunted with this for the rest of his life.

Trying my best not to let it affect my bias because I myself haven't found it.

This is something I found interesting. The judge said: He had more than enough reason to believe he was in danger of death or great bodily harm ... (He) was under attack from the first punch to the back of his head until he stabbed Dylan Nuno.'

So, what about the subsequent 11 stabs? This is the problem when the only source is a summary. There's probably more to the quote and it'd be much better to read this in context. Anyway, this is the last i'm posting on this. This is the sort of thing where once people have an opinion they won't change (me included) and I can see this going in circles.

I think It's not ok he died. Sending the kid to prison wouldn't be a good option, but I really think they should know just how bad what they have done was. The kid that died doesn't even have a chance to change himself because he's gone.
