Let me give you my perspective on an event that is likely to happen. Chuck Schumer has urged all his colleagues to vote against Neil Gorsuch. Even though Schumer, among other high ranking Senate Democrats, unanimously confirmed him for the 10th District 10 years ago. Senator Kamala Harris said she can't vote yes for him because he rules based on "legalisms." The implication being he used the rule of law over emotion? That's how I interpreted it anyways. Diane Feinstein made a new word up during the Gorsuch hearing - super precedent - which was quite amusing. Even left-wing news outlets said that Gorsuch did very well in his hearing. The Democrats tried to trap him but couldn't. However, Chuck Schumer has stated that he will filibuster Gorsuch. His reasoning was that Gorsuch was not an acceptable candidate. So if Gorsuch wasn't acceptable, that means whoever else Trump picks has no chance. Trump and Mitch McConnell have both said Gorsuch will be the next justice - indicating nuclear option. If Senate Dems force the turtle to use the nuclear option, like Harry Reed did, they will surely regret it, and here's why. First off, Scalia was further right than Gorsuch, with Gorsuch, you are essentially just replacing Scalia so you aren't losing any position on the SCOTUS. Once GOP goes nuclear, all that will change. Ginsberg is 84 years old, and looks like she won' be alive much longer, or she will retire. Justice Kennedy is 80, and is considering retiring, Justice Thomas is a Republican and is considering retiring, Justicer Beyer is 78. Trump may get up to a total of 5 new supreme court picks, he most likely will if he gets re-elected. Once nuclear option is used Trump could nominate anyone he wants. If Steve Bannon was a judge, he could nominate someone like Bannon and the Dems couldn't do anything about it. They are fighting the wrong fight. They aren't doing anything but destroying their own future of the Supreme court simply because they don't like Trump. This is a bad mistake by Schumer, and it's purely personal. As his freak out on a Trump supporter who was a Democrat in a Manhattan restaurant demonstrated. As of now, I predict the GOP will gain more senate seats in the midterms. A major reason is due to attrition; who is up for election. I fear that Schumer and Senate Dems hatred for Trump is clouding their judgement.. because this is not a wise move on their part. Going nuclear on SCOTUS nominees would be stupid from a Republican standpoint too though. The Democrats can't filibuster for two years and certainly can't for four. They'll be able to ram him through eventually, just wait enough for it. The Democrats should never have done it for lower court justices and doing it for SCOTUS would be the last nail in the coffin. The opposition party in US politics is underpowered as it is, removing this would make them useless. Seems a good idea when you have the majority, won't feel it later. Though I guess with the older justices, they might do it and hope they get to ram through a couple of more justices in the mean time. No way Ginsberg retires, she despises Trump. Only way she'd let him fill her seat is if she dies. |

I believe (I'll have to double check,) that the institution of the 60 vote threshold for SCOTUS is relatively new. So in essence, nuclear option would only regress the rules back to normal. But that's kind of off topic. You could be right about the GOP regretting it in the future, but if there are five new justices who could be young and extremely conservative, then it doesn't matter who's in the majority since the SCOTUS would be stocked with young 45ish/conservative justices that will preside for at least 30 years. I also contend that this blocking of all things Trump will not end well for them in the next four years. All Trump has to do is complain to his base about democrat obstruction regarding cabinet/scotus/policy, etc, and his base and more independents will come out harder in 2020. Imagine if GOP dominates midterms and Trump wins 2020, especially after GOP goes nuclear. The Democratic ideology would be in dire straights for decades and they couldn't do anything about it because they don't have the votes in congress. Ginsberg won't retire, I agree with that. But she does not look well. She'll be 92 if Trump makes it 8 years. It's questionable whether she will make it that long. Either way, Justices Kennedy and Thomas are both conisdering retirement in the next year or two, and would 86 and 88 years old in 8 years, respectively. Three scotus picks can make a major shift in the political climate. Five could destroy the Democratic party. EDIT: Beyer and Kennedy would be 86 and 88 years old in 8 years, respectively.
